Outline for Radiation Protection Regulations in the USA - Time for an Update and Uniformity

Abstract – There are abundant federal and state radiation protection (RP) statutes and regulations that have been enacted to safeguard the safety of the public, workers, patients, and environment. They have evolved over the years from international and national recommendations and guidance – with an initial construct of a tolerance for biological response, to [now] the inclusion of a
probabilistic model based on epidemiological studies (e.g., A-bomb survivors, radiologists, uranium miners, et al.) at higher level exposure to limit the risk of cancer. Over the past several decades organ and tissue cancer risk estimates have improved, as have respective external and internal dosimetry calculational methods. As a result, the ICRP and NCRP have updated their various RP recommendations and dose limits over the past 75 years. However, our various federal and [thus] state agencies have not kept pace with updating their RP regulations. This presentation will review the historical development of RP regulations in the USA, current science that supports their basis, recently published RP recommendations, research in progress, the ongoing debate over
LNT and ALARA, as well as the related section in presidential executive order 14300 issued in May of 2025. Moving forward, the major questions for the NRC and other federal and state agencies that have RP regulations, and the regulated community, are: is there a better practical and science-based approach for RP with general consensus from practitioners? And if so, what values should all the federal and state regulatory dose limits for the public, workers, and patients be revised to? It is clear the time is now for: a major review of every RP regulation, a check for uniformity between agencies, continue the use of LNT for low-level exposure until there is full scientific consensus on an alternate approach, immediate guidance on implementing ALARA, and developing a plan to update the all RP regulations to anticipated ‘fit for purpose’ RP recommendations when available.
